Franchise Regulations VS Multi Level Marketing Laws

There is a huge rift between the laws governing Multi Level Marketing and Franchise Regulations. And there is also a huge enforcement gap. In fact there is so much over regulation in Franchising, that the regulatory agencies have really hurt America and entrepreneurship.

Franchise sales people are very closely regulated as to what they can and cannot say. In fact even if something is true they are not allowed to say it without empirical proof, proof which costs thousands of dollars to produce. Yet an MLM company can have people sitting in coffee shops running off at the mouth, telling everyone it is a private "Franchise" and say whatever they want.

You see as real franchisor; to be a franchise, has to pay $35,000 for franchise documents, $40,ooo a year for audits, $25,000 per year to stay registered in all the registration and notification states, yet these MLM folks pay little if anything and call their businesses a "private-franchise" they just made up that word? So why can't I call my business, which is a real franchise a "Private Franchise Washing Club" and skip all the rules? I own CarWashGuys.com you see. Or can I simply call it a "Franchise Religion" and skip all the requirements, like the Catholic Church, which resembles a franchise even more than a modern franchise does.

We have double standards, as the MLMs do not monitor their sales folks and the government can call a real franchisor a "Fraudster" make up false declarations file them against the founders and their company. A company, which the founder may have worked their entire life to build up; screw that crap. Where is fair? It is all a lie really.

So whereas we can talk about political reform in the mass media all day; what about regulatory reform, bureaucracy reform? How can we call an honest business man a crook and then let 40,000 per day meetings at coffee shops blow smoke up the rears of unsuspecting recruits of MLM companies, using trickery, vagueness, dodging questions, etc. If a franchisor did that in franchising, they would throw them in jail. And even if they did nothing wrong of the sort, well someone could say they did, how could anyone prove they didn't kick their dog? My dog cannot speak English; can yours? Think on this in 2008.

Network Marketing Vs Traditional Franchise Business Model

Network Marketing is often called The People’s Franchise because it let almost any body to start the business with very low investment and earn reasonable residual income monthly if you follow the business system.

Network Marketing relate very closely to the concept of traditional franchise. Why people buy a franchise because it is branded and has a proven system to run the business and can still enjoy a nice return of investment (R.O.I) when execute correctly.

Let’s take McDonald’s franchise as an example. It may take half a million dollars or more to purchase a McDonald Franchise. After that a specific training system on how to run the business is given to you. You will follow the detailed manual to set up your restaurant, which ingredient to buy and where to order from, learn where the burger and French-fry makers go, what your employees needs to wear, and what to say.

You will also learn how to greet your customers, up-sell and thank them for coming. Every detailed information is all laid down in the manual for the franchise’s owner to follow and run the successfully.

But McDonald’s Franchise also does not guarantee success. It also depends on the location you pick to run the business, the employee you train and the management team you have. As a McDonald Franchisee, you also are required to pay royalties to the Master Franchisor.

Network Marketing Business is slightly different. You can position yourself as a franchisee and also the master franchisor. You will still be given the proven system to setup your business. But over here, since you are also a master franchisor, you are able to sell the franchise to other interested franchisee. And this is power! Because of this business model, many people are able to earn exponential income from network marketing if follow the step by step system correctly.

The entry level for network marketing is very easy. Anybody with age of eighteen years old and above can start the business already. The low start up cost and system attracts almost any one to kick start the business. Since it is a low investment, they do not approach as seriously as buying a half million dollars McDonald franchise.

Once they join, they do not follow the system, they experiment unproven methods, they promote to people when it’s convenient to do so, and treat their business like a hobby. The worst part is that, they do not duplicate their success and develop leaders. That is why; many people did not succeed in the business.

In order to succeed in network marketing, it is very simple. Just follow the proven system and train others to follow the system. That’s it!

Franchise Advantages and Challenges

There are advantages and challenges to nearly every business model. The key is to understand what they are and the impact they'll have on your business ahead of time so you know what to look out for. The idea here is not to scare you away from franchising. On the contrary, the more you know about the challenges involved the more likely you will be a successful franchisee.

Advantages

A franchise system gives you the best of both worlds: established systems, purchasing power, and professional advice from those who have been through opening a unit on the one hand, and personal, local ownership that creates a bond with customers on the other (what Mom-and-Pops are known for).

Established Systems

An established concept gives you brand recognition and gives customers a level of comfort that they know what they can expect from your business. Franchises can, by and large, open for business sooner than an independent, who has to start from scratch, enabling you to begin recuperating your loans faster.

Purchasing Power

The benefits of the increased purchasing power you will enjoy through a franchise are straightforward. Spending less money increases your profit. You will enjoy lower overhead because you're essentially buying everything in bulk, from food products to kitchen appliances. And you won't spend money on things you don't need - the logistics and troubleshooting has been done for you.

Note that you may not realize the full benefits of bulk purchasing if you are the first unit in a new city or region. Distribution costs vary by region and, if you're the only unit, there are fewer economies of scale. Be sure to consult other franchisees regarding their experiences in this area.

Professional Advice

Plus, in a franchise system, there is no such thing as a first time task, because someone (a field rep, another franchisee, experienced vendors) has been through it before. So, if you need a special permit from the city in order to sell goods at a street festival, another franchisee can probably tell you which department to call, what to specifically ask for ("make sure to allow for a generator"), and what factors to avoid ("don't leave trash in the area - they are very strict"). Franchise support personnel share best practices among their store owners and serve as an information resource for system tools.

Marketing through advertising is rarely successful unless done on a large scale, targeting audiences via many venues and with tremendous frequency. This is impossibly expensive for a small business to achieve without economies of scale. Through the combined marketing fund your franchise manages you will get the benefits of name and brand recognition. It is up to you to make the most of the brand recognition by using local store marketing techniques to establish your location and reputation in your community. The combined efforts of your franchise advertising and your local marketing can be a powerful and lucrative combination.

Financing

It can be difficult for small businesses to acquire substantial financing to get a solid start. When you have the backing of a popular and proven franchise it can be easier to get sufficient funds at reasonable rates and schedules to get off on the right foot. While this also will depend on your business history and finance savvy, a big name and established concept can have the same beneficial impact on your financial backers as it will your customers.

Challenges

The challenges of being a franchisee often have to do with unreasonable expectations - you're not your own boss, the brand is your boss. If you want to serve beer (because your customers are asking for it), but the franchise has a policy against selling beer, you can't sell beer. Brand standards reach every part of your business, from uniforms and how they are worn to what types of coupons you can and cannot use. Know your tolerance for rule-following and look for a system that fits your comfort level.

Keep this in mind, even if you follow all brand standards, adhere to all franchise-prescribed processes, and cross all T's and dot all I's, other franchisees in your market may not - and this will affect your business. Franchisee inconsistency defeats the purpose of a franchise, whether it's your inconsistency or someone else's. You're only as strong as the weakest link.

Another thing to watch out for in a franchise system is relying too heavily on the parent company's services. You are one of many and the success or failure of your store is completely up to you. Know what services are guaranteed from the franchisor and be realistic about what you need to do in order to make your business a success. If you're waiting on a national ad campaign to drive your sales, you might be very disappointed in the results.

There are other issues too, which do not always affect all businesses, even within the same concept. Territory rights might make it impossible to obtain a great location, channel conflict (especially online or through grocery stores) can reduce demand at your physical location, and the use of only approved vendors ("I have a guy who can do this for less...") often are not thought of before signing the franchise agreement. Keeping all of these factors in mind while conducting franchise research and UFOC research will help you sign an agreement you can live with.

Take Accurate Measurements

Remember it never hurts to double check, or even triple check, your measurements. Having these measurements will allow you to draw an accurate floor plan that will let you maximize the available space.

Identify Physical Changes Immediately

Sometimes you will not need to make any physical improvements to the site, but if you do it's important to get them completed in a timely manner. That way there will be no physical changes or construction to worry about when it's time to start moving your furniture.

Know The Site Inside & Out

You need to know your site inside and out. Be mindful of light fixtures, electrical outlets, phone lines, etc. Many of these amenities will be essential in how you lay out your store. There is no point in having a computer desk setup on a wall where there are no outlets or a reception desk where there are no phone lines. If caught early, many of these small details can be fixed fairly inexpensively and will spare you major headaches later in the move in process.

Submit As Soon As Possible

Submit a sample floor plan to your franchise headquarters as soon as you have it completed. Floor plans almost always need to be approved by franchisors, and there are no guarantees on how long it will take them to get back to you.
